Registered Retail Customer (RRC) - Policies & Procedures
Introduction
It is the responsibility of all Registered Retail Customers (RRCs) of YOR, the Company, to read, understand, and adhere to these Policies and Procedures, in their current form and as may be amended from time to time. These Policies and Procedures are incorporated into the YOR RRC Enrollment and Agreement.

Registered Retail Customers (RRC)
An RRC is simply a retail customer who purchases YOR products at retail price for his/her own personal or family use and is not permitted to resell any YOR products.

To become an RRC you must be referred by a Select Customer (SC) or Distributor. You can register by completing the RRC Enrollment form online here (please have your Sponsor’s username on hand). There are no fees or requirements to become an RRC.

Sales Tax All
YOR products are subject to the sales tax in the state, county, or city that levies such a tax in which a sale occurs. This tax is calculated on the purchase price of the products being purchased. The sales tax added to the product purchase price will be based on the delivery destination.

Ordering Products
RRCs may purchase products online thru the YOR Health website or directly from your sponsor. Please keep a copy of your order confirmation or sales receipt for your records.

Product Availability
In the event that the requested product is on backorder or no longer available, the RRC will be notified for other available options. Any other products ordered that are currently in stock will be shipped, pending payment authorization.

Autoship
Autoship is 100% optional and allows you to purchase YOR products at autoship prices and receive your products at a specified billing/shipping cycle without the need to physically reorder when you run out of product. Only SCs and Distributors will receive the autoship discount of up to 10% off of retail price; RRCs will be charged the normal retail price for each product. There is no limit for the number of products you set up on autoship.

Autoship requires that you have a valid credit card on file. Your credit card will be automatically charged for the selected products, shipping, and applicable sales tax each billing/shipping cycle; your product(s) will be shipped once your credit card has been authorized. Please be sure to have the funds available in your account prior to the autoship date as this may cause a delay in processing your order or may result in the cancellation of your autoship.

You may set up autoship through your initial enrollment online or through your RRC Admin at the YOR Health website. Once autoship is initiated, you will have the option to pick the date you want autoship to begin. You have the option to change your autoship cycle in increments of 1 to 8 weeks. Autoship will remain in effect until you cancel this option or when payment is not received. You may cancel autoship at anytime.

Any cancellations or changes must be made more than three (3) business days prior to the next autoship date. Any cancellations or changes may be made through the RRC Admin.

Should you decide to cancel the autoship order(s) after the product(s) have already been billed and shipped, YOR will only refund the amount charged for the product(s) with any applicable sales tax once the merchandise has been returned to YOR. YOR will not refund any shipping and handling fees that you may incur.

Delivery and Payment Methods
YOR will not ship orders on a C.O.D. basis. All orders must be prepaid with an authorized credit card. All orders will be shipped within three (3) business days of payment, unless an unforeseen event causes a delay in shipment.

Release of Name(s), Photo(s), Audio & Video Recording(s), and Printed Statement(s)
YOR shall be entitled to the full and unlimited use of any or all names, photographs, likenesses, images, voice recordings, video recordings, or printed statements from any RRCs during their association with YOR. Additionally, any images, reproductions or photographs of houses, automobiles, gatherings or events shall also be obtainable and optioned for use by YOR at their sole discretion. No remuneration, payment or permission shall be required of YOR or from the RRCs to use such images, recordings, photos or statements.

Waiver
YOR never gives up its right to insist on compliance with these rules or with the applicable laws governing the conduct of a business. This is true in all cases, both specifically expressed and implied, unless an officer of YOR who is authorized to bind YOR in contracts or agreements specifies in writing that YOR waives any of these provisions.

Governing Laws
These rules are reasonably related to the Laws of the State of California and shall be governed in all respects thereby. The parties agree that jurisdiction and venue shall in all cases be the County of Orange in the State of California.

Invalidity of Any Paragraph
Should any portion of these Policies and Procedures and Terms and Conditions, or any other instruments referred to herein or issued by YOR, be declared invalid by a court of competent jurisdiction, the balance of such rules, applications, or instruments shall remain in full force and effect.

Confidentiality
YOR's business relationship with its vendors, manufacturers and suppliers is confidential. An RRC shall not contact, directly or indirectly, or speak to or communicate with any representative of any supplier or manufacturer of YOR except at a Company sponsored event at which the representative is present at the request of YOR. Violation of this regulation may result in termination and possible claims for damages if the vendor/manufacturer's association is compromised by the RRC’s contact.

Reporting Violations
RRCs are encouraged to report any violations of the Policies and Procedures to the YOR Corporate Office. Any reporting of a violation will be kept confidential between the reporting person and YOR.

Amendments
YOR expressly reserves the right to alter or amend prices, product availability and/or formulation, Policies and Procedures, and Terms and Conditions. Such amendments are automatically incorporated as part of the agreement between YOR and the RRC when published in official company literature including the YOR Health website.

RRC Return/Refund Policy

Health Product Guarantees, Returns, and Procedures for Returns

Money Back Guarantee
Thirty (30) Day Return Policy - 100% unconditional, 30-day, money-back guarantee to all Retail Customers (RC) or Registered Retail Customers (RRC) (less shipping if applicable). If for any reason an RC or RRC is dissatisfied with any YOR product, he/she may return the product to the Distributor from whom the product was purchased, or to YOR if purchased directly from the YOR Health website, within thirty (30) days from the date of purchase for a replacement, exchange, or full refund of the purchase price. Please refer to the “Customer Return Policy” below for further details.

Retail Customer Return Policy
Retail Customer who purchased directly from a Distributor
If an RC requests a refund within thirty (30) days of purchase, the RC must request the refund directly from the Distributor whom they purchased the products from.

The RC must return all products along with a copy of the YOR Sales Receipt or packing slip before a refund can be issued.

Registered Retail Customer who purchased directly from the Yor Health Website
If an RRC requests a refund within the 30 Days of Purchase, the RRC must call YOR Customer Care to obtain a Return Merchandise Authorization Number (RMA#).

The RRC is responsible for returning, and insuring the return of the product to YOR (Refer to “Procedure for All Returns” for further details).
  After receiving the returned merchandise, YOR will refund the order within 10 business days.
Only one refund per product will be given for opened containers.
  This limitation does not apply to unopened bottles.
YOR reserves the right to refuse sale to and/or terminate any customer who may show abuse of YOR’s 100% unconditional, thirty (30) day, money-back guarantee.
YOR reserves the right to reject repetitive returns or replacements. (the 6R’s)

Procedure for all Returns (applies only to RRCs who purchased products thru YOR Health Website)
To receive a refund, exchange, or replacement on product purchased from YOR Health Website,
an RRC Must:

Call YOR Customer Care for an RMA# and return shipping address. RRCs must call within thirty (30) days to receive an RMA #.
The RMA # is required on all returns and must be clearly marked on the outside of the return package.
  Returns without an RMA # clearly marked on the package may be returned to the shipper and/or will not be processed for a refund.
The product(s) to be returned must be postmarked within thirty (30) days of the date of purchase.
Return the product with the original order confirmation or packing slip to YOR.
Products shipped must be packaged in a manner that prevents damage to the product in transit.
YOR recommends the sender to insure and track all returns, as YOR is not liable for items lost in transit.


Select Customer (SC) - Policies & Procedures
Introduction
It is the responsibility of all Select Customers (SCs) of YOR, the Company, to read, understand, and adhere to these Policies and Procedures, in their current form and as may be amended from time to time. These Policies and Procedures are incorporated into the YOR SC Enrollment and Agreement.

Select Customers (SC)
An SC is a customer who purchases YOR products at wholesale or autoship discounted prices for his/her own personal or family’s use and receives SC rewards. An SC is not permitted to resell any YOR products and does not participate in the YOR Compensation Plan.

To become an SC you must complete an SC Enrollment form and pay a one-time Lifetime Membership fee of $50 at the time of enrollment. You can enroll by completing the SC Enrollment form online here (please have your Sponsor’s username on hand).

If an SC is interested in becoming a Distributor, he/she may do so by following the steps outlined in the “Road to Distributorship”.

Sponsorship
Your sponsor shall be the SC or Distributor that referred and enrolled you.

Any cross-sponsorship is strictly prohibited within YOR.
Sponsorship may also occur in other foreign nations as approved by YOR, bearing in mind the need for personal contact In regard to any dispute, YOR reserves the right to make any final decisions.

Transfers of Sponsorships
YOR prohibits any transferring from one sponsorship to another. The integrity of the entire network organization is based on the strength of the structure within the network.

Sales Tax

Sanctions and Enforcement Action

Sanctions will not be employed lightly, nor will YOR be arbitrary or unfair in their use. It is important to remember, however, that an SC who violates these Policies and Procedures jeopardizes the integrity and standing of all SCs.

YOR reserves the right to revoke the status of SCs or place violators on probation for a period which may delay their eligibility to participate in the marketing plan. It is for the benefit of everyone that every SC abides by the letter and spirit of these Policies and Procedures.

Confidentiality
YOR's business relationship with its vendors, manufacturers and suppliers is confidential. An SC shall not contact, directly or indirectly, or speak to or communicate with any representative of any supplier or manufacturer of YOR except at a YOR sponsored event at which the representative is present at the request of YOR. Violation of this regulation may result in termination and possible claims for damages if the vendor/manufacturer's association is compromised by the SC’s contact.

Fraudulent Accounts
Any SC found to be creating fraudulent accounts without the consent of the person for which the account has been created will have his/her account terminated. Additionally, YOR reserves the right to take legal action against those using fraudulent information or creating fraudulent accounts.

Amendments
YOR expressly reserves the right to alter or amend prices, product availability and/or formulation, Policies and Procedures, and Terms and Conditions. Such amendments are automatically incorporated as part of the agreement between YOR and the SC when published in official YOR literature including the YOR Health website.

SC Return/Refund Policy
Health Product Guarantees, Returns, and Procedures for Returns

Money Back Guarantee
Thirty (30) Day Return Policy - 100% unconditional, 30-day, money-back guarantee to all SCs (less shipping if applicable). Restrictions apply, see below for more info.

Select Customer Return Policy
The Thirty (30) Day Money Back Guarantee applies to any consumable item an SC purchases for the first time.
Membership Fees and the Select Customer Information (SC Info) Kit are non-refundable after the 3rd business day of the SC enrollment date; you the buyer may cancel this transaction at any time prior to midnight of the third business day after the date of this transaction for a full refund.
If an SC elects to cancel his/her membership within thirty (30) days from the date of his/her enrollment, YOR will refund 100% of the price of all consumable products purchased that was part of the SC’s initial order (excluding shipping).
Please note that this 100% refund (less shipping) does not apply once the SC places his/her second order of like products.
Additional unused, unopened and resalable products purchased by an SC wishing to leave the company may be covered by our BuyBack Policy listed below.
The canceling SC must return the product(s) and the entire SC Info Kit (if applicable-and within 3 business days of enrollment) to YOR, along with the Return Merchandise Authorization Number (RMA #).
After YOR receives the returned merchandise, YOR will refund the order within 10 Business Days.
YOR reserves the right to refuse sale to and/or terminate any SC membership who may show abuse of YOR’s Money Back Guarantee.

BuyBack Policy
The BuyBack policy is meant to protect individuals who want to cancel their lifetime membership and who believe they had mistakenly purchased more product than they could consume.
SCs are only eligible for YOR’s BuyBack policy on their most recent order. Since SCs are not allowed to resell products, there should be no reason for SCs to stock more products than they can consume.
The request for a BuyBack must be made within one year of the products’ original purchase date. Reimbursement will be made for the value of the original order less 10% for restocking, freight, rebates, bonuses and personal discounts. YOR reserves the right to not repurchase products or issue refunds on products that have been opened and consumed.
The repurchase price of the last order placed (if in resalable condition) will be not less than 90 percent of the original net cost you paid. Net cost does not include shipping and handling or administrative fee.
Items are deemed resalable or reusable if they are returned within one year of the date of purchase, and are unused/unopened and in their original packaging. Items that have been discontinued, or are within six (6) months of expiring, are not considered to be resalable. Items that do not have current labels are deemed not resalable. Any damages to the product, as the result of mispackaging or improper shipping for the return shipment, shall be your sole responsibility and considered non-resalable.
Literature sales are final and are non-refundable.
All BuyBack returns need to follow Procedure for all Returns.
BuyBack Policies Controlled by Specific State Law: In some states there is a statute or regulation that provides for a different BuyBack Policy. YOR will conform to all such laws.
  In Georgia: We will repurchase all unencumbered products, sales aids, literature, and promotional items which are in a reasonably resalable or reusable condition and which were acquired by the participant from YOR. The repurchase shall be at a price not less than 90 percent of the original net cost to the participant of the goods being returned. For purposes of this paragraph, “original net cost” means the amount actually paid by the participant for the goods, less any consideration received by the participant for purchase of the goods that is attributable to the specific goods now being returned. Goods shall be deemed “resalable or reusable” if the goods are in an unused, commercially resalable condition at the time the goods are returned to YOR. Goods which are no longer marketed by YOR shall be deemed “resalable or reusable” if the goods are in an unused, commercially resalable condition and are returned to YOR within one year from the date YOR discontinued marketing the goods; provided, however, that goods which are no longer marketed shall not be deemed not “resalable or reusable” if the goods are sold to participants as non-returnable, discontinued, or seasonal items and the non-returnable, discontinued, or seasonal nature of the goods was clearly disclosed to the participant seeking to return the goods prior to the purchase of the goods by the participant.
  In Maryland, Oklahoma, Idaho and Texas: On written request from the purchaser, and not later than the first anniversary of the purchaser’s date of purchase, all unencumbered products that are in an unused, commercially resalable condition at a price not less than ninety percent (90%) of the amount actually paid by the purchaser for the products being returned, less any consideration received by the purchaser for purchase of the products being returned. A product that is no longer marketed by YOR is considered resalable if the product is otherwise in an unused, commercially resalable condition and is returned to the seller not later than the first anniversary of the purchaser’s date of purchase, except that the product is not considered resalable if before the purchaser purchased the product it was clearly disclosed to the purchaser that the product was sold as a non-returnable, discontinued, seasonal, or special promotion item.
  In Massachusetts and Wyoming: We will repurchase all unencumbered products in a resalable condition then in the possession of the participant. The repurchase shall be at a price of not less than ninety percent (90%) of the original net cost to the participant returning such goods, taking into account any sales made by or through such participant prior to notification to YOR of the election to cancel.
  In Louisiana: We will i) repurchase all or part of any product that are in a resalable condition at 85% of the original net cost to you, and ii) repay 85% of the original net cost of any services provided to you, and iii) refund ninety percent (90%) of any other consideration you paid to us in order to participate in the marketing program.
  In Montana: Montana residents who cancel their membership within 15 days are entitled to a 100% refund of any consideration given to participate.


YOR Privacy Policy

The YOR Privacy Policy is intended to protect all Customers, including but not limited to, Registered Retail Customers (RRC), Select Cutomers (SC), and Distributors (hereafter referred to as “Customers”)of YOR’s Electronic Media, including but not limited to, YOR websites, YOR emails, YOR home portals, and RRC, SC and Distributor Admins (hereafter referred to as “YOR Media”).

Information Collection
Information is collected from Customers at several different points in YOR Media. YOR is committed to making sure that the privacy and security of all Customers is protected. YOR will not sell any information to any third party or mass marketer.

Use of Information
Personal Information
YOR may collect personal information from Customers to provide a service, place an order, or fulfill a request. Personal information may also be required for identification and verification purposes. YOR will only discuss payment information (e.g. credit card numbers) with the Customers.

Additionally, personal information may be used by YOR to investigate and prevent any fraudulent activity that may be unlawful or potentially harmful to YOR’s Customers, the integrity of YOR, as well as any violations of YOR’s Terms & Conditions and Policies & Procedures.

Non-Personal Information
YOR may collect non-personal information for tracking information, statistics, and marketing research purposes. This information will allow YOR to review activity and be used to help improve YOR Media. All information collected will be used solely to improve YOR’s services, products and enhance YOR’s customers’ overall experience.

Registration
In order to use the services of YOR Media, a Customer may first complete the enrollment form. During enrollment the Customer is required to give YOR contact information such as name and address in order to create a username@yor.net. YOR uses this information to contact the Customer about services on YOR Media which he/she has expressed interest. YOR does not require Customers to provide demographic information, but do require unique identifiers such as a username, email address, and member ID. YOR does require a Customer’s social security and driver’s license number as well as a routing and account number if the Customer would like to pay via Electronic Funds Transfer (EFT).

Order
YOR requests information from the Customer on the order form. The Customer must provide contact information and financial information. This information is used for billing purposes and to fill the Customer’s orders. If YOR has trouble processing an order, the information is used to contact the Customer.

Profile
YOR stores information that is collected through cookies, log files, and/or third parties to create a profile of YOR Customers. A profile is stored information that YOR keeps on individual Customers that details their viewing preferences. Consequently, collected information is tied to the Customer’s personally identifiable information to provide offers and improve the content of the site for the Customer. This profile is used to tailor a Customer’s visit to YOR Media, and to direct pertinent marketing promotions to them. YOR does not share Customer profiles with other third parties.

Cookies
A cookie is a piece of data stored on the Customer’s computer tied to information about the Customer. YOR uses both session ID cookies and persistent cookies. For the session ID cookie, once Customers close the browser, the cookie simply terminates. A persistent cookie is a small text file stored on the Customer’s hard drive for an extended period of time. Persistent cookies can be removed by following Internet browser help file directions.

By setting a cookie on YOR Media, Customers would not have to log in a password more than once, thereby saving time while on YOR Media. If a Customer rejects the cookie, he/she may still use YOR Media. The only drawback to this is that the Customer will be limited in some areas of YOR Media. Persistent cookies enable YOR to track and target the interests of YOR Customers to enhance the experience on YOR Media. Some of YOR’s business partners use cookies on YOR Media. However, YOR has no access to or control over these cookies.

Third Party Advertising
The ads appearing on YOR Media are delivered to Customers by BeFree.com, CJ.com, Linkshare.com, and Performics.com, YOR’s Web advertising partners. Information about Customers’ visit to YOR Media, such as number of times they have viewed an ad, is used to serve ads to Customers on this site. This privacy statement covers the use of cookies by YOR only and does not cover the use of cookies by any advertisers.

Log Files
Like most standard website servers YOR uses log files. This includes internet protocol (IP) addresses, browser type, internet service provider (ISP), referring/exit pages, platform type, date/time stamp, and number of clicks to analyze trends, administer the site, track Customer’s movement in the aggregate, and gather broad demographic information for aggregate use. IP addresses, etc. are not linked to personally identifiable information.

Communications from the Site
YOR sends all new members a welcoming email to verify password and username. Established members will occasionally receive information on products, services, special deals, and newsletters. All customers will receive an order confirmation, order receipt and shipment confirmation via email.

Legal Disclaimer
Though YOR makes every effort to preserve Customer privacy, YOR may need to disclose personal information when required by law wherein YOR hase a good-faith belief that such action is necessary to comply with a current judicial proceeding, a court order or legal process served on the YOR Hesalth website.

These are the instances in which YOR will share Customer’ personal information:

Third Party Intermediaries
YOR uses an outside shipping company to ship orders, and a credit card processing company to bill Customers for goods and services. These companies do not retain, share, store or use personally identifiable information for any secondary purposes.

Service Providers
YOR partners with other third parties to provide specific services. When the Customer signs up for these particular services, YOR shares names, or other contact information that is necessary for the third party to provide these services such as credit card processing. These third parties are not allowed to use personally identifiable information except for the purpose of providing these services.

Business Transitions
In the event YOR goes through a business transition, such as a merger, being acquired by another company, or selling a portion of its assets, Customers’ personal information will, in most instances, be part of the assets transferred.

Links
YOR Media contains links to other sites. Please be aware that YOR is not responsible for the privacy practices of such other sites. YOR encourages all Customers to be aware when they leave YOR Media and to read the privacy statements of each and every website that collects personally identifiable information. This privacy statement applies solely to information collected by YOR Media.

Surveys & Contests
From time-to-time YOR Media requests information from Customers via surveys or contests. Participation in these surveys or contests is completely voluntary and the Customer therefore has a choice whether or not to disclose this information. The requested information typically includes contact information (such as name and shipping address), and demographic information (such as zip code). Contact information will be used to notify the winners and award prizes. Survey information will be used for purposes of monitoring or improving the use and satisfaction of YOR Media. Customers’ personally identifiable information is not shared with third parties unless YOR gives prior notice and choice. Though YOR may use an intermediary to conduct these surveys or contests, they may not use Customers’ personally identifiable information for any secondary purposes.

Chat Rooms, Message Boards, and Public Forums
Please keep in mind that whenever Customers voluntarily disclose personal information online - for example on message boards, through e-mail, or in chat areas - that information can be collected and used by others. In short, by posting personal information online that is publicly accessible, Customers may receive unsolicited messages from other parties in return.

Security
YOR takes every precaution to protect YOR’s Customers’ information. When Customers submit sensitive information via the Web site, their information is protected both online and off-line. When YOR’s enrollment/order form asks Customers to enter sensitive information (e.g. such as credit card number, social security number, etc.) that information is encrypted and is protected with the industry standard encryption software – Secure Socket Layer (SSL). While on a secure page, such as the order form, the lock icon on the bottom of Web browsers such as Apple Safari and Microsoft Internet Explorer becomes locked, as opposed to un-locked, or open, when Customers are just ‘surfing’.

While SSL encryption is used to protect sensitive information online, YOR also does everything in its power to protect Customer information off-line. All of YOR’s Customers’ information, not just the sensitive information mentioned above, is restricted in the YOR office. Only employees who need the information to perform a specific job are granted access to personally identifiable information. Furthermore, ALL employees are kept up-to-date on YOR’s security and privacy practices. YOR employees are notified and/or reminded about the importance YOR places on privacy, and what they can do to ensure all Customers’ information is protected. Finally, the servers that store personally identifiable information are in a secure environment, behind a locked cage in a locked facility.

Supplementation of Information
In order for YOR Media to properly fulfill its obligation to Customers, it is necessary for YOR to supplement the information received with information supplied from third party sources.

ID Address Verification
YOR uses third party software to verify a Customer’s identity and address to match billing information records.

Correcting/Updating Personal Information
If a Customer’s personally identifiable information changes (such as zip code, phone, email or postal address), or if a Customer no longer desires YOR’s service, YOR provides a way to correct and update a Customer’s personally identifiable information. This can usually be done by contacting Customer Care or through the Customer’s Admin.

Notification of Changes
If YOR decides to change YOR’s privacy policy, YOR will post those changes to this privacy statement, the homepage, and other places YOR deems appropriate so Customers are always aware of what information is collected, how its is used, and under what circumstances, if any, YOR disclosed it. If, however, YOR is going to use Customerss’ personally identifiable information in a manner different from that stated at the time of collection YOR will notify Cutomers by posting a notice on YOR Media for 30 days.
